Rainer v. State

The Supreme Court denied Petitioner’s petition to reinvest jurisdiction in the trial court to proceed with a petition for writ of error coram nobis and Petitioner’s motion for default judgment, holding that Petitioner was not entitled to relief.Petitioner was convicted of second-degree murder. After his conviction was affirmed, Petitioner filed the instant petition seeking permission from the Supreme Court to proceed in the trial court with a petition for writ of error coram nobis, arguing that trial error resulted in the imposition of an illegal sentence. Petitioner later filed a motion for default judgment. The Supreme Court denied both filings, holding that the factual basis for Petitioner’s claims was insufficient to go beyond allegations of a defective information and trial error, which do not implicate the facial validity of a trial court’s judgment or jurisdiction.
