Duck v. State

by
The Supreme Court affirmed Defendant’s conviction of first-degree murder and sentence of life imprisonment, holding that there was no abuse of discretion or error in the proceedings below.Specifically, the Court held (1) the circuit court did not err by denying Defendant’s motions to exclude testimony of an expert witness, an agent of the FBI, and Defendant’s motion for mistrial for use of the witness’s testimony for alleged discovery violations because Defendant failed to establish a Brady violation; and (2) Defendant failed to preserve for appeal his argument that the circuit court erred in allowing the admission of “content” based text messages in response to a subpoena without a warrant.
