Lewis v. State

Appellant appealed his convictions of capital murder and kidnapping, arguing that the circuit court erred in denying his motions to suppress on five separate grounds. The State cross-appealed, arguing that the circuit court erred in granting Appellant’s motion to suppress evidence seized pursuant to two search warrants. The Supreme Court affirmed the denial of Appellant’s motions to suppress and dismissed the State's cross-appeal, holding (1) with regard to some of Appellant’s motions to suppress, the circuit court did not err in denying the motions, and with regarding to the remaining motions the court was precluded from addressing Appellant’s arguments; and (2) the State’s cross-appeal was untimely.
