Canada v. State

Appellant entered a plea of guilty to first-degree battery of a child in violation of Ark. Code Ann. 5-13-201(a)(9). Appellant was sentenced to 480 months imprisonment. Thereafter, Appellant filed a pro se petition to correct the sentence imposed, arguing that his sentence was illegal because it exceeded the sentence prescribed in the Arkansas Sentencing Commission Guidelines. The trial court denied the petition. Appellant appealed. The Supreme Court dismissed the appeal, holding that the sentence was not illegal because it was within the range set by statute, and therefore, Appellant was not entitled to relief. View "Canada v.
